These Terms of Service (“Terms”) govern your use of birchtech.com.au (the “Website”) and the services offered by Birch Tech (also trading as Birch Technologies) (“we”, “us”, “our”). By using the Website or engaging our services, you agree to these Terms. If you do not agree, please do not use the Website.

1. Who we are

Birch Tech is a Sydney-based telecommunications and technology installer (antenna, NBN, data cabling, TV/AV, CCTV and smart-home work) and a disclosed referrer/broker of internet connection services. We are a registered cabler; mains-voltage electrical work is carried out by our licensed electrical partner under AS/NZS 3000. Contact: info@birchtech.com.au, 1300 287 256.

2. The Website

The Website is provided for general information about our services. We try to keep it accurate and up to date but make no warranty that the content is complete, current or error-free. We may change, suspend or withdraw any part of the Website at any time.

3. Quotes and pricing

Any prices shown on the Website (including care-plan, package and installation figures) are indicative “from” prices for general guidance only. They are not an offer and do not form a contract.
A binding price is only provided in a written quote tailored to your address, site conditions and requirements. Quotes are valid for the period stated on them (or 30 days if not stated).
Work proceeds once you accept a quote. Additional work discovered on site (e.g. access, cabling runs, remediation) may be quoted separately before it is carried out.

4. Connection-broking and referrals (Starlink / NBN / ISP)

Where we help you choose and connect an internet service, we act as a disclosed referrer/broker. We compare a panel of providers we have arrangements with, plus the connection types available at your address — this is not a whole-of-market comparison.
If you sign up to a provider through us, we may receive a referral fee or commission from that provider, at no additional cost to you. How we make money is disclosed on the relevant pages of the Website.
Your service contract for any internet plan is between you and the provider, on the provider’s terms. We are not the supplier of those services and are not responsible for provider pricing, availability, speeds, outages or support.
Starlink is a product of SpaceX. We are an independent installer and referrer — we are not affiliated with, sponsored by, or an authorised reseller of, Starlink or SpaceX unless expressly stated in writing.

5. Bookings, work and your responsibilities

You agree to provide safe and reasonable access to the site, accurate information about the property, and any necessary permissions (including from owners, body corporate or landlords). You are responsible for back-ups of your own data and equipment. Risk and any agreed warranty terms for installed equipment are set out in your quote or invoice.

6. Payment

Payment terms are as stated on your quote or invoice. Title to any supplied goods remains with us until paid in full.

7. Consumer guarantees

Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the ACL. To the extent permitted by law, our liability for a breach of a non-excludable guarantee is limited to re-supplying the service or paying the cost of having it re-supplied.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss arising from third-party services (including internet providers), matters outside our reasonable control, or your failure to follow reasonable instructions.

9. Intellectual property

All content on the Website (text, graphics, images and logos) is owned by or licensed to Birch Tech and may not be copied or reused without permission.

10. Privacy

We handle personal information in accordance with our Privacy Policy and the Australian Privacy Principles.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
